ORDINANCE 2022-2

An Ordinance Authorizing the Vacation of the Portion of “D” Court between East and Mill Streets in the City of Hazleton

WHEREAS, pursuant to the Petition submitted by Vincent Fayock and Monica Fudge, owners of property abutting the subject street, the City wishes to vacate a portion of “D” Court, which is undedicated by the city, and between East and Mill Street in the City of Hazleton;

WHEREAS, the proposed vacation will subserve the public interest and will relieve the Municipality of the burden of maintenance of that portion of the right of way; and

WHEREAS, the effect of this proposed vacation will acknowledge that the public character of this paper street is extinguished; however, any applicable private rights or easements concerning this paper street cannot be extinguished by this governing body, and an action to quiet title would be necessary for any person seeking title to the property at issue.

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Hazleton, Pennsylvania, as follows:

SECTION 1: That there is hereby vacated the portion of the public street known as “D” Court between East and Mill Street in the City of Hazleton, Luzerne County, Pennsylvania;

SECTION 2: That all Ordinances or parts of Ordinances consistent herewith be and the same are hereby repealed.

ORDAINED AND ENACTED by Council this 8TH day of February, 2022.
