ORDINANCE 2021-27
An Ordinance Authorizing the Vacation of the Undedicated Portion of Pardee Street having dimensions of 50 feet by 150 feet in the City of Hazleton
WHEREAS, pursuant to the Petition submitted by Victor and Maria Acevedo, owners of property at 846 East Diamond Avenue, the City wishes to vacate a portion of Pardee Street, which is undedicated by the city, and located to the east and adjacent to the Petitioners’ property;
WHEREAS, the size of the undedicated portion of Pardee Street is approximately 50 feet by 150 feet, and is initially shown on a map of the Diamond addition dated January 2, 1913, and located in the archives of the City of Hazleton;
WHEREAS, the proposed vacation will subserve the public interest and will relieve the Municipality of the burden of maintenance of that portion of the right of way; and
WHEREAS, the effect of this proposed vacation will acknowledge that the public character of this paper street is extinguished; however, any applicable private rights or easements concerning this paper street cannot be extinguished by this governing body, and an action to quiet title would be necessary for any person seeking title to the property at issue.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Hazleton, Pennsylvania, as follows:
SECTION 1: That there is hereby vacated as a portion of the public street known as Pardee Street, having dimensions of approximately 50 feet by 150 feet in the City of Hazleton, Luzerne County, Pennsylvania, as more fully shown and described on the map attached to the Petitioners’ Petition as Exhibit B, and attached hereto;
SECTION 2: That all Ordinances or parts of Ordinances consistent herewith be and the same are hereby repealed.
